DORDA implements Data Breach Hotline

In case of a data breach scenario, quick and competent assistance is of most importance. The facts of the case in particular the categories of data and data subjects affected have to be clarified in due course. Thus it is necessary to take the required steps to remedy the situation and to minimize the risks involved within a very limited period of time. Despite the internal documentation both a notification (i) to the Data Protection Authority ("DPA") and (ii) the involved data subjects is required depending on the severity of the case. In case of the need of a notification it has to be submitted with the DPA within 72 hours upon knowledge of the data breach, disregarding any weekends, public holidays or night time.

The first reaction in case of a data breach is already decisive: The quality of the notification as to its level of details , the reliability of the risk assessment and the measures taken shape the first, most important impression with the DPA. One can derive from the submission if the company did take data protection and security seriously or if there are uncertainties and gaps with regard to GDPR compliance.
